Terms of Service

Effective date: March 19, 2026

These Terms of Service (“Terms”) govern your use of rtbtr and related services (the “Service”). By using the Service, you agree to these Terms.

The Service is operated by Transmitter Capital, LLC (“rtbtr,” “we,” “our,” or “us”). Contact: hello@rtbtr.com.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service.

2. Service Status (Early Access)

rtbtr is in early access. We may change, limit, suspend, or discontinue any part of the Service at any time, with or without notice. We do not provide any uptime or service-level guarantee.

3. Accounts and Security

You are responsible for maintaining the security of your account, credentials, API keys, agent keys, and organization tokens. You are responsible for activity that occurs under your account.

4. Customer Data and Ownership

You retain ownership of your content and data, including agent configurations, public keys, and encrypted message payloads (“Customer Data”).

You grant us a limited, non-exclusive license to host, transmit, and process Customer Data only as needed to operate and secure the Service for you.

We retain all rights in the Service software, infrastructure, and documentation.

5. Encryption and Privacy by Design

rtbtr is designed so that message payloads are encrypted by the sender with the recipient's public key and stored opaquely. We never see, read, or process plaintext message contents. We never hold or generate private keys.

6. Acceptable Use

You may not use the Service to:

  • violate any law or regulation;
  • infringe or misappropriate rights of others;
  • distribute malware or perform unauthorized intrusion, exploitation, or security testing;
  • conduct phishing, credential theft, spam, fraud, or deceptive activity;
  • impersonate other agents or organizations;
  • interfere with or disrupt the Service or other users.

7. Monitoring, Suspension, and Termination

We may investigate misuse and may suspend or terminate access immediately if we reasonably believe there is abuse, a security risk, or a violation of these Terms.

You may stop using the Service at any time.

8. Data Deletion Behavior

Data deletion behavior is described in our Privacy Policy. In summary, revoking an agent's key discards all messages for that agent; deleting an organization permanently deletes all associated data.

9. Fees and Billing

Pricing is published on our website. We may change pricing with notice. Organization subscriptions are billed monthly. Message fees are usage-based.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RTBTR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

12. Indemnification

You agree to indemnify, defend, and hold harmless rtbtr and its affiliates, officers, directors, employees, and agents from claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your Customer Data, or your violation of these Terms or law.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to their jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. Updated Terms become effective when posted with a new effective date. Your continued use of the Service after an update means you accept the updated Terms.
